An EU company law framework should help businesses take advantage of opportunities within the Single market, enabling the straightforward setting-up and scaling-up of companies and promoting cross-border mobility.
At the same time, EU company law can be a powerful tool to enable companies to scale up, do business across borders, get a second chance to survive a crisis (e.g. via effective pre-insolvency rules), and promote further use of digital tools in administration.
Our work on Company law covers areas linked to the whole lifecycle of companies. This includes their creation (e.g. rules on company establishment, digitalisation in company registers, whistle-blower protection, initiatives around European company forms, such as the 28th regime), and their recovery (and restructuring) and potential extinction (insolvency). The EU should uphold freedom of establishment within the single market and progress towards further digitalisation and simplification of company law. We are supportive of a 28th regime on company law as an additional tool for SMEs to benefit from the internal market.
