Safe Harbour needs to be reinforced, but must remain in place

Safe Harbor is a streamlined process to comply with EU privacy rules when transferring data across the Atlantic. BUSINESSEUROPE published its views in the context of the Safe Harbor review, urging to maintain the framework in place while strengthening its security. Some of the Safe Harbor elements, such as enforcement and scope, must be revised. Technical solutions like encryption could be encouraged, but must not be made mandatory. The recent developments about government surveillance have had serious negative implications for the digital economy. Governments must ensure a proper balance between national security and respect of citizens’ fundamental rights.
